Who is obliged to keep accounts under tax law?
Merchants within the meaning of the HGB (German Commercial Code) are obliged to keep accounts. This includes anyone who operates a commercial business (if the entrepreneur’s company is entered in the commercial register), with the exception of small traders. A small business is an enterprise if its type and scope do not require that the business to be commercially established. All types of company, namely GmbH, AG, OHG and KG, are also obliged to keep accounts.
